Terms of Service

1. Acceptance

By creating an account or using Matchome.ai (the “Service”) you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and a U.S. resident. The Service currently operates in Florida. Real-estate professionals must hold a valid Florida license to use Agent features.

3. Accounts

You are responsible for the accuracy of information you provide and for keeping your credentials secure. One natural person per account. Multi-role accounts (Buyer + Renter + Owner + Agent) are allowed under a single human identity.

4. Fair Housing & non-discrimination (zero tolerance)

You may not engage in conduct prohibited by the Fair Housing Act (42 U.S.C. §3604(c)) or Florida Fair Housing Act, including but not limited to steering, refusal to deal, or discriminatory expressions or limitations on the basis of race, color, religion, national origin, sex, familial status, disability, age, marital status, sexual orientation, or gender identity. Listings and messages containing protected-class steering language will be removed and accounts terminated. We use automated and human review.

5. Listings & matches

Matchome is a matching platform; we do not own, list, sell, rent, or broker properties. Listing data is sourced from RentCast and ATTOM (third-party MLS data providers) and from owners/agents who post directly. Always verify property details and conduct your own diligence before transacting.

6. User content

You retain ownership of content you submit (photos, briefs, messages). You grant Matchome a worldwide, royalty-free, non-exclusive license to host, display, and process that content solely to operate the Service. You represent that you have the rights to upload all content, including photos and any face depicted therein.

7. Acceptable use

• No spam, harassment, threats, doxxing, or solicitation off-platform.
• No fraud, fake listings, MLS scraping, or stolen photos.
• No CSAM, NCII, or content depicting minors. Violations are reported to NCMEC and law enforcement.
• No automated scraping, bot accounts, or rate-limit evasion.
• No fair-housing violations (see §4).

Violations result in content removal, account suspension, or permanent termination. We may remove a violating account from the Service within 24 hours of confirmation, consistent with App Store Guideline 1.2.

8. Block and report

You can block any user at any time, which prevents future contact. You can report suspected violations from any thread, listing, or profile. We triage according to our published SLA (CSAM & threats: ≤1 hour; harassment: ≤4 hours; fraud: ≤8 hours).

9. Privacy & biometric

Your privacy is governed by our Privacy Policy. Biometric features (face avatars) require separate written consent under the Illinois BIPA and equivalent laws. Consent is revocable at any time.

10. Subscriptions and fees

Buyer and renter use is free. Agent and owner subscriptions, when introduced, are billed via Apple/Google in-app purchase or Stripe. Refunds follow the platform’s standard policy. Auto-renewal disclosure complies with applicable U.S. state laws (CA, OR, NY).

11. Disclaimer

The Service is provided “as is.” We make no warranties about availability, accuracy of listing data, or outcomes of any matched transaction. To the maximum extent permitted by law, we disclaim all implied warranties.

12. Limitation of liability

Our aggregate liability for any claim arising from the Service is limited to the greater of (a) amounts paid by you to Matchome in the 12 months preceding the claim, or (b) US $100. We are not liable for indirect, incidental, consequential, or punitive damages.

13. Dispute resolution & arbitration

Disputes are resolved by binding individual arbitration administered by JAMS in Miami, Florida, under the JAMS Streamlined Arbitration Rules. Class actions and class arbitrations are waived. Either party may bring small-claims-court actions for individual disputes within the court’s jurisdiction. You may opt out of arbitration within 30 days of account creation by emailing legal@matchome.ai with “Arbitration Opt-Out” in the subject line.

14. Termination

You can delete your account anytime in app. We can suspend or terminate accounts that violate these Terms, immediately for severe violations, with notice for minor ones. On deletion, we purge data per the schedule in the Privacy Policy.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Arbitration venue is Miami, FL.

16. Changes

Material changes will be announced in app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
